This agreement’s purpose is for the protection of both the buyer and the breeder. The purchaser agrees to the following conditions:

1. Both Buyer and Breeder/Seller affirm this transaction is not simply a purchase of property but a lifetime commitment to this cat/kitten. If it becomes necessary for Buyer to give up this cat for any reason, Buyer will contact the Breeder/Seller immediately. The Breeder/Seller has first right to take kitten back, at no charge, without refund of payment. Under no circumstances will this cat be sold, leased or given to any pet shop, research facility or be abandoned. Nor will this cat be surrendered to any animal shelter or similar facility. Buyer also agrees that the cat will not be placed or rehomed to anyone without discussion and approval of Breeder/Seller. If Breeder has the ability to assist with placing the cat in new home we will.

2. The kitten will be given two standard vaccinations at the recommended schedule, parasite treatments, a veterinarian examination, and is guaranteed to be in good health at the time of sale.

3. The basic health guarantee extends through 72 hours and covers viral and bacterial diseases, fungal infections, and internal and external parasites. An examination by your own veterinarian is required within this time period to qualify for this guarantee. Please advise us of the results of this examination. If your vet believes the kitten to be ill and that the illness was present prior to sale, contact us immediately. The breeder agrees to reimburse owner for the medical treatment upon receipt of a statement from the examining veterinarian that the illness was present prior to purchase, excluding the cost of the office visit up to but not exceeding the purchase price of the kitten. If the cat/kitten should die from a problem present prior to the sale, the breeder shall either replace the kitten with one of equal quality or refund the purchase price/deposit depending on the purchaser’s and breeder’s consensus. The total liability of the breeder shall in no case exceed the total sale price of this cat/kitten. After 72 hours the health guarantee expires, all liability for any illness of the kitten is the responsibility of the purchaser. Health insurance for this kitten is recommended and information will be provided by the breeder at time of deposit.

4. This kitten is guaranteed to be negative for FeLV and FIV at the time of the sale. This kitten is guaranteed against FIP (Feline Infectious Peritonitis) for one calendar year from date of purchase. If this kitten dies from FIP during this time period, the kitten will be replaced, providing a necropsy is done by a licensed veterinarian with biopsy of abdominal tissue indicating FIP.

5. Vaccinations for Feline Leukemia or FIV are not recommended and will invalidate the health guarantee as research has indicated these vaccinations affect the immune system negatively.

6. This kitten’s parents are guaranteed negative for the HCM (Hypertrophic Cardiomyopathy) gene. They are also guaranteed negative for SMA (Spinal Muscular Atrophy), and PK Def (Pyruvate Kinase Deficiency). Negative genetic test results of parents guarantee negative results for offspring for these specific tests. Parents of the kitten have also tested free of HCM on heart echoes and free of hip dysplasia on x-rays. Kittens are guaranteed against death resulting from genetic or congenital disease for 5 years. Seller will replace the cat with one of equal quality with proof of the genetic (ex: HCM) or congenital condition such as a necropsy report by a veterinarian pathologist for a valid claim.

7. Maine Coons have a potential risk of hip fracture due to their larger, heavier size as compared to most cats. Maine Coons have much higher risk for slipped femoral head capital eiphysis (fracture of femoral head). This breeder believes this to be due to early spay or neuter as a contributing factor and no longer practices ESN. This Breeder/Seller recommends that the Purchaser not spay until 7-9 months for a female or neuter until 11-12 months for a male. Other recommendations include feeding a good quality high protein (grain and legume free) diet and NOT providing cat trees or other furniture taller than 4 feet for their use. The Breeder does not take any responsibility or liability for the treatment of hip fractures should they occur.

8. Breeder reserves the right to cancel this agreement at any time before the kitten leaves for the purchaser’s home if the home is deemed unsafe or if the Purchaser is determined not a good fit for the kitten. In this case, any deposit collected by seller will be returned.

9. The purchaser agrees to be a responsible owner with due consideration of the welfare of the kitten/cat at all times. This includes:

a. The kitten/cat will NOT be declawed or devocalized.

b. The kitten/cat will NOT be allowed to run loose outdoors nor will it be confined to a cage on a regular basis. (Catio or screened porch is not considered a cage)

c. Immunizations will be kept current and the kitten/cat will be kept free of internal and external parasites. Flea preventives that are safe should ONLY be obtained from your veterinarian.

d. The kitten/cat will not be left alone for more than 24 hours unless arrangements are made for a responsible person to provide fresh food, water, clean litter and socialization daily.

e. Kitten will be groomed regularly and kept free of mats. Nails should be clipped regularly.

f. The purchaser will exercise due care and diligence in providing the kitten/cat regular veterinary check-ups, sound, high quality nutrition, and a comfortable and safe environment.

g. If spayed or neutered, the kitten will come with registration papers for TICA and the purchaser may choose a name and submit the papers to TICA at a cost of $15. If unaltered, the kitten purchaser will be supplied with application for registration when documentation of spay or neuter is received. Females need to be spayed at 7-9 months; Males should be neutered between 11-12 months.

h. The purchaser agrees to provide frequent updates and pictures to the breeder of the kitten/cat.

i. The purchaser agrees to inform breeder of any change in address or telephone number.

j. The purchaser agrees to confidentiality in any issues regarding the kitten/cat and will work with breeder to resolve said issue and will not make the issue public on social media.

k. The breeder will be informed of illness or death of the kitten/cat and veterinary reports will be provided if requested.

l. This cat is sold under the provisions and guarantees set forth in this contract. Seller makes no other guarantee other than those specifically described above. Seller’s total liability is limited to the purchase price of this cat. Failure on the part of the Purchaser to honor the terms and conditions of this contract will result in ownership of this cat being reverted to the Seller, with no compensation due the Purchaser. It is agreed that any legal action will be taken in a small claims court in Pinellas County, Florida, and is governed by Florida State Law. The penalty for breach of contract of any condition of this contract is a fine of $2000. All legal fees and cost incurred by Breeder/Seller shall be responsibility of Buyer/Purchaser.

I am in full agreement with and agree to abide by all the above terms and conditions of this contract.
